Nicholas Mesiti, a Partner in the firm, is an experienced and versatile intellectual property law practitioner and litigator.  Mr. Mesiti’s practice includes patent infringement, trademark, false advertising, copyrights and unfair competition cases.  Mr. Mesiti has been lead trial counsel in numerous infringement jury and non-jury trials, and appeals.  Mr. Mesiti’s technical and legal abilities have enabled him to handle complex patent infringement cases in various technologies including medical devices, semiconductors, electronics, communication systems, optics, industrial and power generation machinery, biotechnology, pharmaceutical and biopharmaceutical products. His cases have also included other consumer products such as furniture, backpacks, and protein bars.

Mr. Mesiti also counsels clients in all aspects of intellectual property law including rendering of non-infringement, validity and patentability opinions; due diligence investigations, audits and opinions; as well as managing, licensing and acquiring intellectual property portfolios.  Mr. Mesiti has been recognized by his peers as a “Super Lawyer’ in the area of Intellectual Property Law as published in Law & Politics. He is a frequent guest lecturer and presenter in the area of Intellectual Property.

Mr. Mesiti graduated from Rensselaer Polytechnic Institute with a B.S. in Mechanical Engineering in 1985. He acquired his law degree from Albany Law School in 1988.  He is admitted to the bar in New York, and before the U.S. District Court for the Southern, Eastern, Western and Northern Districts of New York, and the U.S. Court of Appeals for the Federal, Fourth and Second Circuits.  Mr. Mesiti has successfully represented clients in many Federal District Courts throughout the United States.  Mr. Mesiti is also registered to practice before the U.S. Patent and Trademark Office.

Mr. Mesiti is a former collegiate basketball player, and has been involved with coaching youth basketball and soccer for many years.  He enjoys spending time with his family including his wife and two children.
