Heslin Rothenberg Farley & Mesiti represented Newkirk Products, Inc., in United States District Court for the District of Massachusetts, civil action no. 06-12146, sued by NewRiver, Inc. for infringement of U.S. Patent 6,122,635 directed to a method of acquiring, identifying and extracting compliance information for mutual funds. The Newkirk service in dispute was EDGAR-View. The firm successfully defended allegations of patent infringement and breach of contract during a three week jury trial held in late March 2009. On April 7, 2009 the jury decided in favor of Newkirk by finding eight of the asserted claims invalid, twelve of the asserted claims not infringed, and no breach of contract, resulting in no liability for our client.
